EDUCATED BETS™ — LEGAL AGREEMENTS

This document combines the Terms of Service, Privacy Policy, User Agreement & Disclaimer, Affiliate Disclosure, and Cookie Policy for Educated Bets™. By checking the agreement box, you confirm you have read and agree to all sections below.

1. TERMS OF SERVICE

1.1 Acceptance of Terms

Welcome to Educated Bets™ ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Educated Bets™ website, mobile applications, and all related services (collectively, the "Platform"). By creating an account, accessing, or using the Platform, you agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must not access or use the Platform. We reserve the right to modify these Terms at any time, and continued use of the Platform following notice of any changes constitutes your acceptance of the revised Terms.

1.2 Eligibility

To use the Platform, you must:

• Be at least 21 years of age (or the minimum legal age for sports betting and gambling-related content in your jurisdiction, whichever is higher);
• Reside in a jurisdiction where accessing sports analytics, predictions, and sports betting affiliate content is lawful;
• Not be a professional athlete, referee, or official of any sport for which we provide predictions;
• Not be prohibited by any applicable law, regulation, or governing body from using our services;
• Have the legal capacity to enter into a binding contract.

Age verification: We reserve the right to request proof of age and identity at any time. Accounts found to belong to minors will be immediately terminated.

1.3 Account Registration

When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Notify us immediately of any unauthorized use of your account;
• Not share your account credentials with any third party;
• Not create accounts under false identities or misrepresent your eligibility;
• Maintain only one active account per individual.

1.4 Nature of the Service

Educated Bets™ provides AI-generated sports analytics, statistical analysis, historical data, predictive modeling outputs, and related informational content ("Analytics Content"). The Platform also contains affiliate links to licensed sportsbooks and sports betting operators ("Third-Party Partners").

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• All Analytics Content is provided for informational and entertainment purposes only;
• No content on the Platform constitutes professional gambling advice, financial advice, or a guarantee of any outcome;
• Past performance data and AI predictions do not guarantee future results;
• We do not operate as a licensed gambling operator, bookmaker, or gambling advisor in any jurisdiction;
• Gambling involves substantial financial risk, and you may lose money.

1.5 Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable federal, state, or local law;
• Scrape, data mine, or systematically extract data from the Platform without express written consent;
• Attempt to reverse engineer, decompile, or disassemble any portion of the Platform or its AI models;
• Distribute, sell, or sublicense any content from the Platform without authorization;
• Transmit any viruses, malware, or other harmful computer code;
• Harass, threaten, or harm other users or our employees;
• Use bots, automated scripts, or other tools to access the Platform;
• Circumvent any access controls, security measures, or geographic restrictions;
• Use the Platform if you are located in a jurisdiction where such use is illegal.

1.6 Intellectual Property

All content, features, functionality, AI models, algorithms, trademarks, logos, and software comprising the Platform are the exclusive property of Educated Bets™ or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial use.

1.7 Disclaimers and Limitation of Liability

THE PLATFORM AND ALL ANALYTICS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EDUCATED BETS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF OR RELIANCE ON THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

1.8 Indemnification

You agree to defend, indemnify, and hold harmless Educated Bets™, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.

1.9 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state of Massachusetts. Any dispute shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the American Arbitration Association's Consumer Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

1.10 Termination

We may suspend or terminate your account at our sole discretion, with or without cause or notice. Upon termination, your right to use the Platform ceases immediately.

2. PRIVACY POLICY

2.1 Introduction

Educated Bets™ is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Platform, and is designed to comply with applicable privacy laws including the CCPA/CPRA, VCDPA, Colorado Privacy Act, and other applicable state statutes.

2.2 Information We Collect

Information You Provide:
• Account registration data (name, email address, username, password)
• Age verification information and state of residence
• Payment information (processed through secure third-party processors)
• Communications you send to us

Information Collected Automatically:
• Device information (IP address, browser type, operating system)
• Usage data (pages viewed, links clicked, time on Platform)
• Geolocation data (state/region level for compliance)
• Cookies and similar tracking technologies (see Section 5)

2.3 How We Use Your Information

We use your information to provide and improve the Platform, verify your age and eligibility, personalize your experience, process transactions, comply with legal obligations, track affiliate referrals, communicate with you, detect fraud, and conduct analytics research.

2.4 Sharing of Information

We do not sell your personal information. We may share it with service providers, affiliate partners (limited transaction data for commission tracking), legal authorities when required by law, and in connection with business transfers.

2.5 Your Privacy Rights

2.6 Data Security

We implement commercially reasonable technical and organizational security measures, including encryption in transit and at rest. No method of transmission over the Internet is 100% secure.

2.7 Children's Privacy

The Platform is not directed to individuals under the age of 21. We do not knowingly collect personal information from minors.

3. USER AGREEMENT & DISCLAIMER

3.1 Informational Nature

By creating an account and using the Platform, you expressly acknowledge:

• Educated Bets™ provides AI-powered sports analytics solely for INFORMATIONAL AND ENTERTAINMENT PURPOSES;
• Nothing on the Platform constitutes a guarantee regarding the outcome of any sporting event;
• AI predictions are inherently probabilistic; actual outcomes may differ substantially;
• You are solely responsible for any betting or gambling decisions you make;
• We expressly disclaim all liability for financial losses arising from your reliance on any Platform content.

3.2 No Professional Gambling Advice

Educated Bets™ is NOT a licensed gambling advisor, handicapper, or sports betting consultant. No content should be interpreted as a recommendation to place any specific bet. Sports outcomes are influenced by countless unpredictable variables, and long-term profitable sports betting is not achievable by the majority of participants.

3.3 Financial Risk Acknowledgment

YOU EXPRESSLY ACKNOWLEDGE THAT SPORTS BETTING CARRIES SUBSTANTIAL FINANCIAL RISK. You represent that you will never bet money you cannot afford to lose, will set and adhere to personal betting limits, and will not use credit or borrowed money to fund gambling activities.

3.4 AI Model Limitations

Our AI models are trained on historical data and cannot account for real-time information such as last-minute injuries or weather changes. Models may have biases, and past predictive accuracy does not guarantee future performance.

3.5 Third-Party Links

The Platform contains links to third-party sportsbooks as part of our affiliate partnerships. We have no control over their content, privacy practices, or terms of service.

4. AFFILIATE DISCLOSURE

4.1 FTC Compliance Statement

Educated Bets™ participates in affiliate marketing programs with licensed sportsbooks and betting operators. In accordance with FTC Endorsement and Testimonial Guidelines (16 C.F.R. Part 255):

IMPORTANT DISCLOSURE: Educated Bets™ earns commissions from sportsbooks and betting platforms when users click affiliate links and register or deposit at those platforms. This is how we generate revenue to operate the Platform.

4.2 Nature of Affiliate Relationships

When you click on a link to a sportsbook on our Platform, we may receive a one-time registration commission, a deposit-based commission, ongoing revenue sharing, or hybrid compensation structures.

4.3 Effect on Our Content

Our affiliate relationships may influence which sportsbooks are featured and the placement of certain links. However, our Analytics Content and AI predictions are developed independently and are not influenced by our affiliate relationships.

4.4 Affiliated Partners

Our current and potential affiliate partners may include major licensed US sportsbook operators such as FanDuel, DraftKings, BetMGM, Caesars Sportsbook, BetRivers, and similar operators. Using our affiliate links does not cost you any additional fees or charges.

5. COOKIE POLICY

5.1 Types of Cookies We Use

• Strictly Necessary Cookies: Essential for account authentication, session management, and security. These cannot be disabled without affecting Platform functionality.
• Performance and Analytics Cookies: Collect information about how users interact with the Platform (e.g., Google Analytics).
• Functional Cookies: Remember your preferences and settings for a more personalized experience.
• Affiliate Tracking Cookies: Track referrals to affiliate partners. These do not capture your payment information or betting history.

5.2 Cookie Management

5.3 Cookie Retention Periods

• Session cookies: Deleted when you close your browser
• Authentication cookies: Expire after 30 days of inactivity
• Analytics cookies: Retained for up to 26 months
• Affiliate tracking cookies: Retained for 30–90 days (depending on partner requirements)

Age Verification: We reserve the right to request proof of age at any time. Accounts found to belong to minors will be immediately terminated.

Jurisdictional Note — Sports betting is currently legal in the following states (always verify current law): New Jersey, Pennsylvania, Michigan, Illinois, Colorado, Virginia, Indiana, Iowa, Tennessee, West Virginia, Arizona, Connecticut, Louisiana, New York, Ohio, Maryland, Kansas, Massachusetts, Kentucky, Vermont, North Carolina, Maine, Nebraska, Rhode Island, and others. Utah and Hawaii currently prohibit all forms of gambling. You are responsible for knowing and complying with your local laws.

2.5 Our Commitment to Responsible Content
